These Terms and Conditions govern access to and use of https://treasureafricanmarket.com, purchases from Treasure African Market, and orders completed through our website.

By accessing the website, creating an account, or placing an order, you agree to these Terms and Conditions.

  • Monday to Saturday: 10:00 a.m. to 7:00 p.m.
  • Sunday: 12:00 p.m. to 5:00 p.m.

Store hours may change on holidays, during emergencies, or for operational reasons. Current hours should be confirmed through the website or by contacting the store.

2. Website Use

The website and its contents are provided for personal, lawful shopping and informational purposes.

Users must not:

  • Use the website for unlawful, fraudulent, or abusive purposes
  • Attempt to gain unauthorized access to the website or another customer’s account
  • Introduce viruses, harmful code, or automated attacks
  • Interfere with website security or operation
  • Submit false contact, billing, payment, or delivery information
  • Copy or commercially exploit website content without authorization
  • Place fraudulent orders or misuse promotions

We may restrict website access, suspend an account, cancel an order, or take other reasonable action where fraud, abuse, security concerns, or violations of these terms are suspected.

3. Product Information

We make reasonable efforts to display accurate product names, descriptions, photographs, packaging, sizes, weights, ingredients, origins, availability, and prices.

However:

  • Product packaging or labelling may change
  • Photographs may not exactly represent the product received
  • Colours and appearance may vary by screen
  • Produce and other natural products may vary in size, shape, colour, and appearance
  • Product availability may change without notice
  • Manufacturers may change ingredients or product formulations
  • Product weights may vary, particularly for meat, produce, and goods sold by approximate weight

Customers should read the current package label before consuming or using a product.

4. Food Allergies and Dietary Requirements

Treasure African Market sells food products that may contain or come into contact with allergens, including nuts, peanuts, milk, eggs, wheat, soy, sesame, fish, shellfish, mustard, and other allergens.

Product descriptions and website information are provided for general convenience. Ingredients, manufacturing practices, and packaging may change without notice.

Customers with allergies, intolerances, health conditions, religious dietary requirements, or other dietary restrictions are responsible for:

  • Reading the product’s current ingredient and allergen label
  • Contacting the manufacturer where additional information is required
  • Contacting Treasure African Market before ordering when clarification is needed

We cannot guarantee that any product is completely free from a particular allergen unless expressly confirmed by the product manufacturer.

5. Prices, Taxes, and Charges

Unless otherwise stated:

  • Product prices are displayed in Canadian dollars
  • Displayed product prices do not include GST
  • Delivery, shipping, service, or other applicable charges are not included in the displayed product price
  • Applicable taxes and charges are calculated and shown during checkout before the order is submitted

Delivery or shipping fees may depend on distance, destination, parcel size, weight, required handling, or the available service provider.

6. Pricing and Listing Errors

We make reasonable efforts to keep website prices and product information accurate. However, typographical, technical, synchronization, data-entry, or system errors may occasionally occur.

When an error is discovered before an order is fulfilled, Treasure African Market may:

  • Correct the website information promptly
  • Contact the customer and explain the error
  • Offer the customer the opportunity to approve an accurately stated price or product
  • Remove the affected item from the order and refund the amount paid for it
  • Cancel and refund the affected order when necessary

We will not substitute a higher price after purchase without notifying the customer and obtaining any approval required by law.

Nothing in this section limits rights provided under applicable consumer-protection or competition law.

7. Product Availability

Submitting an order does not guarantee that every ordered item is available.

Inventory may change before an order is prepared. Products may be unavailable because of stock discrepancies, damage, spoilage, supplier shortages, technical errors, or other circumstances.

When an item is unavailable, we may:

  • Contact the customer about an appropriate substitution
  • Remove and refund the unavailable item
  • Offer store credit with the customer’s agreement
  • Cancel and refund the affected portion of the order

We will not knowingly substitute an item with a materially different product without customer approval.

8. Product Substitutions

When an ordered product is unavailable, Treasure African Market may contact the customer to propose a comparable replacement.

A substitute may differ in:

  • Brand
  • Package size
  • Weight
  • Flavour
  • Country of origin
  • Price

Substitutions requiring an additional charge will not be completed without customer approval.

When the substitute costs less, the difference will be adjusted or refunded as appropriate.

Customers may request no substitutions by adding instructions during checkout or contacting the store promptly after placing the order.

9. Orders and Acceptance

An order confirmation confirms that we received the order. It does not necessarily mean the order has been accepted or can be fulfilled.

An order is accepted when Treasure African Market begins preparing it, confirms it for pickup or delivery, or dispatches it for shipment.

We may refuse or cancel an order where:

  • An item is unavailable
  • Payment cannot be authorized
  • Pricing or product information contains a genuine error
  • The delivery address is incomplete or outside the available service area
  • The order appears fraudulent or abusive
  • Fulfilling the order would be unlawful or unsafe
  • A technical or operational issue prevents fulfillment

When a paid order is cancelled by Treasure African Market, the applicable amount will be refunded to the original payment method, subject to normal payment-processing times.

10. Payment

Payment must be completed using a payment method offered at checkout.

Online transactions may be processed through WooCommerce and an available payment processor, which may include Stripe, Square, or another provider.

Payment providers may apply their own terms, verification requirements, security procedures, and privacy policies.

Treasure African Market may delay or decline an order when payment authorization fails or additional verification is reasonably required.

11. In-Store Pickup

Customers may select in-store pickup when that option is available.

Customers should wait until they receive confirmation that the order is ready before travelling to the store.

We may request:

  • The customer’s name
  • Order number
  • Confirmation email
  • Identification
  • The payment card used for the order

A person collecting an order for someone else may be required to provide the order number and authorization from the purchaser.

12. Local Delivery Area

Local delivery is generally available to eligible addresses within a 20-kilometre radius of the store, as calculated by the website’s delivery-zone application or mapping system.

The website’s determination of whether an address falls within the delivery zone will normally apply. Mapping systems may occasionally produce errors or interpret addresses differently.

Treasure African Market may confirm, correct, accept, or decline a delivery location when necessary.

Local delivery may be performed by store personnel or an available third-party delivery provider.

13. Delivery of Fresh, Frozen, Refrigerated, and Perishable Goods

Fresh, frozen, refrigerated, and other perishable products are available for eligible local delivery within the applicable delivery area.

Customers are responsible for:

  • Providing a complete and accurate delivery address
  • Providing a working telephone number
  • Ensuring someone is available to receive temperature-sensitive products
  • Refrigerating or freezing products promptly after delivery
  • Following storage and preparation instructions shown on the product

Delivery times are estimates and may be affected by traffic, weather, order volume, product availability, and driver availability.

14. Orders Beyond the Local Delivery Area

Orders outside the local delivery area may be sent using an available postal or courier service.

The carrier may vary based on destination, parcel type, cost, availability, and service requirements.

Fresh, frozen, refrigerated, or other temperature-sensitive goods will not normally be mailed or shipped outside the local delivery area unless Treasure African Market expressly confirms that suitable delivery arrangements are available.

We may remove items that cannot safely or reasonably be shipped and refund the amount paid for those items.

15. Delivery Instructions and Unattended Orders

Customers must provide complete delivery information, including unit number, buzzer code, access instructions, and a working telephone number where applicable.

Where a customer authorizes an order to be left unattended:

  • The customer accepts the risk of theft, loss, weather exposure, temperature changes, animal interference, or damage after delivery
  • The order may be left in a reasonably safe location selected by the driver
  • Delivery may be confirmed through a photograph, electronic record, or driver notation
  • Treasure African Market is not responsible for deterioration or loss occurring after successful delivery

Because food safety may be affected by temperature, customers should avoid requesting unattended delivery for frozen, refrigerated, fresh, or perishable products.

A driver is not required to enter a residence.

16. Failed or Missed Delivery

A delivery may be considered unsuccessful when:

  • No one is available to receive an order requiring personal delivery
  • The customer cannot be reached
  • The address is incorrect or incomplete
  • Building access is unavailable
  • The delivery location is unsafe
  • The customer refuses the order without a valid reason

The customer may be responsible for reasonable redelivery, return, storage, spoilage, or disposal costs resulting from incorrect information or failure to receive the order.

Perishable products that cannot safely be returned to inventory may not qualify for a refund when delivery failed because of the customer’s actions or incorrect information.

17. Delivery and Shipping Estimates

Pickup, delivery, and shipping times are estimates rather than guarantees unless we expressly agree otherwise in writing.

Delays may result from:

  • Weather
  • Traffic
  • High order volume
  • Product availability
  • Courier delays
  • Incorrect addresses
  • Building-access problems
  • Mechanical problems
  • Events outside our reasonable control

Customers should contact the store promptly when an order appears significantly delayed.

18. Order Changes and Cancellations

To request a cancellation or order change, customers must telephone Treasure African Market at 1-403-800-7390 as soon as possible.

Sending an email, submitting a website message, or attempting an online cancellation does not guarantee that the request will be seen or completed before preparation or dispatch.

Whether an order can be cancelled depends on its status.

A full cancellation may be available when preparation has not begun. Once an order has been prepared, packed, transferred to a delivery provider, dispatched, or made ready using perishable products, cancellation may be refused or may be subject to deductions for products or costs that cannot reasonably be recovered.

Cancellation rights provided by applicable law are not affected.

19. Returns and Refunds

Purchases are subject to the Treasure African Market Refund and Returns Policy posted on the website.

Perishable, refrigerated, frozen, fresh, opened, sanitary, health-related, and food products may be subject to additional restrictions because they cannot safely be returned to inventory.

Nothing in these terms removes any mandatory rights or remedies available under applicable law.

20. Customer Inspection and Order Problems

Customers should inspect orders as soon as possible after pickup or delivery.

Missing, damaged, spoiled, defective, or incorrect products should be reported promptly. Reports involving perishable, fresh, frozen, or refrigerated products should generally be made within 24 hours of pickup or delivery.

We may request:

  • The order number
  • A receipt or proof of purchase
  • Photographs of the product, packaging, date code, or damage
  • A description of the problem
  • That the product or packaging be retained until the claim is reviewed

Failure to report a temperature-sensitive or perishable-product issue promptly may prevent us from determining when or how the problem occurred.

21. Customer Accounts

Customers may shop as guests or create an account.

Account holders are responsible for:

  • Providing accurate information
  • Maintaining the confidentiality of login credentials
  • Activity completed through their account
  • Notifying Treasure African Market of suspected unauthorized access

We may suspend or close an account used for fraud, abuse, unauthorized access, unlawful activity, or repeated violation of these terms.

22. Intellectual Property

Website text, graphics, logos, photographs, page designs, and other original content belonging to Treasure African Market may not be copied, republished, sold, or commercially exploited without permission.

Product names, trademarks, and packaging belonging to manufacturers remain the property of their respective owners.

23. Third-Party Services and Links

The website may contain links, embedded content, payment services, maps, delivery tools, analytics services, and other third-party features.

Treasure African Market does not control every third-party service and is not responsible for its independent content, availability, security, or privacy practices.

24. Website Availability

We do not guarantee uninterrupted or error-free website operation.

We may modify, suspend, update, or discontinue any part of the website for maintenance, security, technical, operational, or business reasons.

25. Limitation of Liability

To the fullest extent permitted by law, Treasure African Market is not liable for indirect, incidental, special, or consequential losses arising from website use, delivery delay, third-party service interruption, or misuse or improper storage of a product.

Nothing in these terms excludes or limits liability that cannot legally be excluded, including mandatory consumer rights.

Customers remain responsible for following product labels, food-safety instructions, storage requirements, preparation directions, allergy warnings, and manufacturer guidance.

26. Events Beyond Our Control

Treasure African Market is not responsible for delay or failure caused by circumstances reasonably outside our control, including severe weather, fire, flood, utility interruption, internet outage, labour disruption, transportation interruption, government action, supply shortage, public-health emergency, or courier disruption.

27. Privacy

Personal information is handled in accordance with the Treasure African Market Privacy Policy.

28. Governing Law

These Terms and Conditions are governed by the laws of Alberta and the applicable laws of Canada.

Any dispute will be handled by a court or tribunal with jurisdiction in Alberta, subject to any mandatory consumer rights or jurisdictional rules.

29. Changes to These Terms

We may update these Terms and Conditions when our services, operations, website, or legal obligations change.

The updated terms will be posted on the website with a revised effective date.

Terms applying to an order will generally be the terms in effect when that order was placed, except where a change is required by law.
